1. Introduction
Welcome to The Dermatician Ltd. These Terms and Conditions (“Terms”) govern your use of our website and the skincare consultation services (“Services”) we provide.
By accessing our website or booking our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our website or Services.
In these Terms, “we,” “us,” and “our” refer to The Dermatician Ltd., and “you” or “the Client” refers to you, the user of our Services.
2. Our Services
The Dermatician Ltd. provides personalised skincare consultations for educational and informational purposes only. Our services include, but are not limited to, skin analysis, routine building, product recommendations, and general skincare advice.
Crucially, our Services do not constitute medical advice, diagnosis, or treatment. We are not a medical practice and our consultants are not medical doctors. Our advice is not intended to replace the relationship between you and your General Practitioner (GP) or dermatologist. You should always consult a qualified medical professional for any health concerns or before making any changes to your medication.
3. Bookings, Payments, and Cancellations
a. Bookings: All consultation services must be booked in advance through the scheduling system on our website. You will receive a confirmation email upon successful booking.
b. Payment: Payment for all Services is required in full at the time of booking to secure your appointment. We use a secure third-party payment processor, and your payment details are not stored by us.
c. Cancellation Policy: We understand that circumstances can change.
If you cancel your appointment with more than 48 hours’ notice, you will receive a full refund.
If you cancel your appointment with less than 48 hours’ notice, or if you fail to attend your appointment, the fee is non-refundable.
To cancel or reschedule, please contact us directly via the email address provided in your booking confirmation.
d. Late Arrival: If you are late for your appointment, the consultation will still end at the scheduled time. No refund or discount will be provided for the time lost.
4. Client Obligations
As a Client, you agree to:
Provide accurate, complete, and truthful information regarding your health, skin history, and any medications or products you are currently using. The quality of our advice is dependent on the accuracy of the information you provide.
Follow our advice and product recommendations at your own risk. It is your responsibility to perform patch tests for any new products recommended to ensure you do not have an adverse reaction.
Inform us of any changes to your health or medication status during the course of our consultations.
5. Intellectual Property
All content included on our website, including but not limited to text, graphics, logos, images, and the compilation thereof, is the property of The Dermatician Ltd. and is protected by UK and international copyright laws. You may not reproduce, distribute, or create derivative works from any of our content without our express written permission.
6. Disclaimers and Limitation of Liability
a. No Medical Advice: You acknowledge and agree that our Services are for informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment from a qualified doctor. We do not prescribe medication.
b. No Guaranteed Results: Skincare is highly individual. While we provide expert, evidence-based advice, we do not guarantee any specific results. Individual outcomes will vary depending on factors such as skin type, lifestyle, genetics, and adherence to the recommended plan.
c. Product Recommendations: All product recommendations are made in good faith based on our professional opinion and the information you provide. We are not liable for any adverse reactions to products you choose to use.
d. Limitation of Liability: To the fullest extent permitted by law, The Dermatician Ltd. shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our Services. Our total liability to you for any claim arising out of or in connection with our Services shall not exceed the total amount paid by you for the specific Service giving rise to the claim.
7. Confidentiality
We are committed to protecting your confidentiality. All personal and health information you share with us will be held in the strictest confidence, as detailed in our Privacy Policy.
8. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the law of England and Wales.
You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.
